Acceptance
It is not necessary for any Client to have signed an acceptance of these terms and conditions for them to apply. If a Client accepts a quote then the Client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full. Please Read these terms and conditions carefully. Any purchase or use of ourservices implies that you have read and accepted our terms and conditions.
Charges
Charges for services to be provided by EASYWEBES are defined in the project quotation that the Client receives via e-mail. Quotations are valid for a period of 30 days. EASYWEBES reserves the right to alter or decline to provide a quotation after expiry of the 30 days.
Unless agreed otherwise with the Client, all website design services require an advance payment of a minimum of 40% of the project quotation total before the work is supplied to the Clients for review. A second charge of 40% percent is required after the development stage, with the remaining Twenty(20) percent of the project quotation total due upon completion of the work, prior to upload to the server or release of materials.
Payment for services is acceptable by cheque or Bank transfer or Payment Gateway.
Refund and Cancellation Policy
Our focus is complete customer satisfaction. In the event, if you are displeased with the services provided, we will refund back the money, provided the reasons are genuine and proved after investigation. Please read the fine prints of each deal before buying it, it provides all the details about the services or the product you purchase.
In case of dissatisfaction from our services, clients have the liberty to cancel their projects and request a refund from us.
Our Policy for the cancellation and refund will be as follows:
Cancellation Policy For Cancellations please contact us via contact number and email. Requests received later than 3 to 5 business days prior to the end of the current service period will be treated as cancellation of services for the next service period.
Refund Policy
We will try our best to create the suitable design concepts for our clients. In case any client is not completely satisfied with our products we can provide a refund. If paid by credit card, refunds will be issued to the original credit card provided at the time of purchase and in case of payment gateway name payments refund will be made to the same account.
Except UPI transaction ,If any payment is made by credit card debit card and net banking on the payment gateway. Than according to the payment gateway fee, the company will charge 2% + GST on refund transaction amount.
Client Review
EASYWEBES will provide the Client with an opportunity to review the appearance and content of the website during the design phase and once the overall website development is completed. At the completion of the project, such materials will be deemed to be accepted and approved unless the Client notifies EASYWEBES otherwise within ten (10) days of the date the materials are made available to the Client.
Turnaround Time And Content Control
EASYWEBES will install and publicly post or supply the Client’s website by the date specified in the project proposal, or at date agreed with Client Upon MICROTECH receiving initial payment, unless a delay is specifically requested by the Client and agreed by EASYWEBES.
In return, the Client agrees to delegate a single individual as a primary contact to aid EASYWEBES with progressing the commission in a satisfactory and expedient manner. During The project, EASYWEBES will require the Client to provide website content; text, images, movies and sound files.
Failure To Provide Required Website Content:
EASYWEBES is a small business, to remain efficient we must ensure that work we have programmed is carried out at the scheduled time. On occasions we may have to reject offers for other work and enquiries to ensure that your work is completed at the time arranged. This is why we ask that you provide all the required information in advance. On any occasion where progress cannot be made with your website because we have not been given the required information in the agreed time frame, and we are delayed as a result, we reserve the right to impose a surcharge of up to 25%.
If your project involves Search Engine Optimisation we need the text content for your site in advance so that the SEO can be planned and completed efficiently. If you agree to provide us with the required information and subsequently fail to do within one week of project commencement we reserve the right to close the project and the balance remaining becomes payable immediately. Simply put, all the above condition says do not give us the go ahead to start until you are ready to do so.
NOTE: Text content should be delivered as a Microsoft Word, email (or similar) document with the pages in the supplied documents representing the content of the relevant pages on your website. These Pages should have the same titles as the agreed website pages. Contactus if you need clarification on this.
Using our content management system you are able to keep your content up to date yourself. If Client will not provide required data or contents for Website Development Purpose within 30 Days after Initial Payment, We will give you reminders mean while but even though client will fail to provide data then thereafter EASYWEBES will not be responsible for work delay neither advance payment will not refunded by any reasons.
Payment
Invoices will be provided by EASYWEBES upon completion but before publishing the live website. Invoices are normally sent via email or in hand ; however, theClient may choose to receive hard copy invoices. Invoices are due upon receipt. Accounts that remain unpaid thirty (30) days after the date of the invoice will be assessed a service charge in the amountof the higher of one and one-half percent (1.5%) or Rs.500 per month of the total amount due.
Additional Expenses
Client agrees to reimburse EASYWEBES for any additional expenses necessary for the completion of the work. Examples would be purchase of special fonts, stock photography etc.
Web Browsers
EASYWEBES makes every effort to ensure websites are designed to be viewed by the majority of visitors. Websites are designed to work with the most popular current browsers (e.g. Firefox, Internet Explorer 8 & 9,Google Chrome, etc.). Client agrees that MICROTECH cannot guarantee correct functionality with all browser software across different operating systems. EASYWEBES cannot accept responsibility for web pages which do not display acceptably in new versions of browsers released after the website has been designed and handed over to the Client.
Default
Accounts Unpaid thirty (30) days after the date of invoice will be considered in default. If the Client in default maintains any information or files on EASYWEBES Web space, EASYWEBES will, at its discretion,remove all such material from its web space. EASYWEBES is not responsible for any loss of data incurred due to the removal of these srvice.
Removal of such material does not relieve the Client of the obligation to pay any outstanding charges assessed to the Client’s Account. Cheques returned for insufficient funds will be assessed a return charge of Rs.250/-and the Client’s account will immediately be considered to be in default until full payment is received. Client’s with accounts in default agree to pay EASYWEBES reasonable expenses, including legal fees and costs for collection by third-party agencies, incurred by EASYWEBES in enforcing these Terms and Conditions.
IfClient will not agree to make payments as per mentioned in Work Agreement EASYWEBES has right to stop working on your Project. If Clients do not work further on any projects no payment will be refunded as EASYWEBES would have to spend working hours to execute that work.
Termination
Termination Of services by the Client must be requested in a written notice and will be effective on receipt of such notice. E-mail or telephone requests for termination of services will not be honoured until and unless confirmed in writing. The Client will be invoiced for design work completed to the date of first notice of cancellation of payment in full within thirty (30) days.
Indemnity
All EASYWEBES services may be used for lawful purposes only. You agree to indemnify and hold EASYWEBES harmless from any claims resulting from your use of our service that damages you or any other party.
Copyright
TheClient retains the copyright to data, files and graphic logo provided by the Client, and grants EASYWEBES the rights to publish and use such material. The Client must obtain permission and rights to use any information or files that are copyrighted by a third party.
The Client is further responsible for granting EASYWEBES permission and rights for use of the same and agrees to indemnify and hold harmless EASYWEBES from any and all claims resulting from the Client’s negligence or inability to obtain proper copyright permissions. A contract for website design and/or placement shall be regarded as a guarantee by the Client to EASYWEBES that all such permissions and authorities have been obtained. Evidence of permissions and authorities may be requested.
Standard Media Deliveryt
Unless Otherwise specified in the project quotation, this Agreement assumes that any text will be provided by the Client in electronic format(ASCII text files delivered on floppy disk or via e-mail or FTP) and that all photographs and other graphics will be provided physically in high quality print suitable for scanning or electronically in.gif, .jpeg, .png or .tiff format. Although every reasonable attempt shall be made by EASYWEBES to return to the Client any images or printed material provided for use in creation of the Client’s Website, such return cannot be guaranteed.
Design Credit
A Link to EASYWEBES will appear in either small type or by a small graphic at the bottom of the Client’s website. If a graphic is used,it will be designed to fit in with the overall site design. If a client requests that the design credit be removed, a nominal fee of 10% of the total development charges will be applied.
Access Requirements
If the Client’s website is to be installed on a third-party server, EASYWEBES must be granted temporary read/write access to the Client’s storage directories which must be accessible via FTP.
Depending on the specific nature of the project, other resources might also need to be configured on the server.
Post-Placement Alterations
EASYWEBES cannot accept responsibility for any alterations caused by a third party occurring to the Client’s pages once installed. Such alterations include, but are not limited to additions, modifications or deletions.
Domain Names
EASYWEBES may purchase domain names on behalf of the Client. Payment and renewal of those domain names is the responsibility of the Client.The loss, cancellation or otherwise of the domain brought about by non or late payment is not the responsibility of EASYWEBES. The Client should keep a record of the due dates for payment to ensure that payment is received in a good time.
General
These Terms and Conditions supersede all previous representations,understandings or agreements. The Client’s signature below or payment of an advance fee constitutes agreement to and acceptance of theseTerms and Conditions. Payment online is an acceptance of our terms and conditions.
Governing Law
This Agreement shall be governed by Indian Law
Liability
EASYWEBES hereby excludes itself, its Employees and or Agents from all and any liability from:
- Loss Or damage caused by any inaccuracy;
- Loss Or damage caused by omission;
- Loss Or damage caused by delay or error, whether the result of negligence or other cause in the production of the web site;
- Loss Or damage to clients’ artwork/photos, supplied for the site.Immaterial whether the loss or damage results from negligence or otherwise.
Severability
In the event any one or more of the provisions of this Agreement shall be held to be invalid, illegal or unenforceable, the remaining provisions of this Agreement shall be unimpaired and the Agreement Shall not be void for this reason alone. Such invalid, illegal or unenforceable provision shall be replaced by a mutually acceptable valid, legal and enforceable provision, which comes closest to the intention of the parties underlying the invalid,
Hosting / Virtual Private Servers/Dedicated Servers/Payment Gateways
EASYWEBES haven’t own hosting servers or data centers, so we purchase WebHosting Space, Virtual Servers , Dedicated Servers and Payment Gateway Services from Third Party Service Providers as per client’s request only.
EASYWEBES is not responsible nor liable for any monetary or non-monetary loss due to Website Hacking, Data loss etc. But it doesn’t mean We will not help you. EASYWEBES will help to resolve such issues in good faith but not bound to do that.
Renewals
After several reminders regarding Renewals from EASYWEBES, if a client fails to make payment against renewal, respective services will be terminated immediately and no backup data will be provided to clients.
EasyWebes will not be responsible for any loss due to termination of such services nor bound to give further intimation. If Client needs a softcopy of data, they have to make payment as per company policy .
